About the compensation calculation

The right to compensation arises when the employer misses the established payment deadline and an amount remains due to the employee. Compensation accrues in addition to the debt for each calendar day of delay. The calculator shows the statutory minimum under Article 236 and splits the delay into key-rate periods.

When is compensation for delayed salary payable?

Compensation is payable when the established payment deadline has passed and an amount due to the employee remains fully or partially unpaid. It accrues automatically from the next calendar day after the deadline through the actual settlement date, inclusive.

Which payments are covered by Article 236 of the Russian Labour Code?

The rule covers salary, holiday pay, termination payments, and other amounts due to the employee. After a partial payment, compensation accrues on the amount that remains unpaid.

Must the employer's fault be proven?

No. The obligation to pay compensation arises regardless of the employer's fault or the reason for the delay.

Is compensation payable if the salary was not accrued?

Compensation on an amount that was not accrued on time applies when a final court judgment has recognized the employee's right to receive it. The calculator does not determine that right and calculates only from the data entered by the user.

When does the delay start?

From the calendar day after the contractual payment date. The day of actual settlement is included as well.

Are partial payments included?

Yes. Compensation for the partial-payment date uses the previous balance; the reduced balance applies from the next day.

Can the debt and compensation be claimed together?

Yes. Compensation is added to the unpaid salary and does not replace the claim for the underlying debt.

Why may the final amount differ?

The result may change because of confirmed dates, the debt composition, partial payments, a court ruling on an unaccrued amount, or a higher contractual rate.
