About the DDU penalty calculation

The penalty may arise when a developer misses the contractual handover deadline. The statutory rate is doubled to 1/150 of the Bank of Russia key rate for an individual and is 1/300 for a legal entity or sole trader. Moratoria, special rules, and disputed terms require document review.

When does a DDU penalty arise?

There must be a DDU, an expired handover deadline, and actual handover after that deadline. The agreement and handover act should support the dates and price.

Which rate applies to an individual?

An individual uses the doubled rate of 1/150 of the Bank of Russia key rate for every delay day.

Which rate applies to a legal entity or sole trader?

A legal entity or sole trader uses 1/300 of the key rate for each delay day unless a special rule applies.

Which dates should I enter?

Enter the contractual handover deadline and the actual handover date. The period runs from the next day after the deadline through the handover date.

What can change the result?

An amendment, deadline extension, price change, moratorium, special regulation, or disputed handover date can change the amount and requires document review.

Which documents support a demand?

Usually the DDU and amendments, payment records, handover act, deadline correspondence, and the demand with proof of delivery.
